WHO IS RESPONSIBLE FOR THE TREATMENT OF YOUR DATA?

FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

In the ASPACE research area we process the information provided by interested parties with the purpose of carrying out a specific research study or investigation, as well as the publication of the results in scientific journals and the presentation at conferences and congresses, if applicable.

Data from identifiable individuals will usually be used temporarily for the duration of the study, but thereafter the study result will contain only anonymized data. The data may be used (with the express consent of the person concerned) for the purpose of the aforementioned clinical research.

Additionally, the results of the studies, once anonymized, can be used for the purposes of:

  • Diffusion of the entity
  • Institute
In those situations for the purposes of dissemination and/or teaching in which it is necessary to present the case of a specific person who can be identified, it will be necessary to request a specific express consent separate from the consent to participate in the research project.
The identifying data of the researchers involved will be processed in order to carry out the research and the data protection impact assessment.
HOW LONG WILL WE KEEP YOUR PERSONAL DATA?

The health data provided by the interested persons will be kept depending on the study for the necessary period (usually between 2 and 10 years). In any case, the person will be informed in the document sent to him.

WHAT IS THE LEGITIMATION FOR THE TREATMENT OF YOUR DATA?

The legal basis for the processing of your data is:

  •  The express consents of the interested party, without in any case the withdrawal of any of these consents conditioning the execution of healthcare.
TO WHICH RECIPIENTS WILL YOUR DATA BE COMMUNICATED?

Under no circumstances will patient data be transferred to any third party. In the case of several studies, they may be transferred to some Universities in which the main researcher participates, but it will be Aspace, through its researcher, who will inform of these transfers in particular with the consent of the interested party.

Apart from the aforementioned, ASPACE hires uses in this process:

  • CEIC: the researchers' data will be transferred to the CEIC through the data protection impact assessment document carried out.
WHAT ARE THE RIGHTS WHEN THE DATA IS PROVIDED TO US?
  • Anyone has the right to get information about whether at the Aspace Catalunya Foundation we are processing personal data that affect them, or not.
  • Interested persons have the right to access to your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request yours deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
  • Interested persons have the right to request the portability of your data. The Aspace Catalunya Foundation will facilitate this portability as long as it is technically feasible.
  • In certain circumstances, those interested may request the limitation of treatment of your data, in which case we will only keep them for the exercise or defense of claims.
  • In certain circumstances and for reasons related to their particular situation, those interested may object to treatment of your data. The Aspace Catalunya Foundation will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.
  • The interested person has the right to withdraw any consent previously granted This will not affect the legality of treatments already carried out based on withdrawn consent.
  • For exercise any of these rights, the interested person will have to address Carrer Tres Pins 31-35 in Barcelona or the electronic address protecciodedades@aspace.cat, providing an identification document and setting out the right that you want to exercise, and if applicable the reasons or particular situation that makes it necessary.   • In any case, the interested person can present one claim before the Catalan Data Protection Agency if you believe that the Aspace Catalunya Foundation has not satisfied your rights correctly.
HOW DID WE OBTAIN YOUR DATA?

In general, the data we process are always provided by the interested person or their family at the time of data collection and capture for the specific research study. In some specific studies, some data can be obtained from the Aspace Clinical History, but every person who participates in a study will have the right to be informed in advance in any case.
