Workshop with families: Modification of the ability to work and preparation for the future

The modification of the capacity to act is a measure of protection and complement, based on which a guardian represents a person in those acts of life in which he has difficulties or cannot govern himself.

Yesterday afternoon, June 11, a training workshop on modifying the ability to work was given at the Center Integral Montjuïc d'Aspace, which was attended by around fifty families of adult school users, occupational centers and residence

The lawyer Adriana Jiménez - specialist in incapacitation processes, and Sílvia Alba - social worker of the residence and STO Aspace Montjuïc, addressed different issues related to the process of modifying the capacity to work, as a measure of protection

People over the age of 18 are recognized as having the capacity to work. From this moment on, it is necessary to consider whether the person can exercise it independently or needs support in order to guarantee their legal protection. The modification of the capacity to act becomes a legal process in which, based on a court ruling, a guardian is assigned who will legally represent the person and provide support in the assistance functions in which they need it. Over time, the situation of the person and their family may change and other future preventive actions will have to be considered.

Emphasis was placed on the assessment of the need to start the process, the definition and alternatives to complement the capacity, the functions of the tutor/ai of other support figures, the guarantee of people's basic rights and planning of the future (will, assignment of guardianship, advance wishes, etc.). Likewise, families were made aware of the functions of guardianship entities, which act as legal entities for the protection and care of people with a modified capacity.
